Terms of Service

1. Introduction and acceptance of these Terms

These Terms of Service (the "Terms") form a binding legal agreement between you ("you", "user", "member", "student", "instructor", "staff", or "applicant", as applicable) and ATC24Academy (the "Academy", "we", "us", or "our"). They govern your access to and use of the ATC24Academy website located at atc24academy.com, any subdomains, the associated Discord community, the training programs, the events, the coordination tools, and any other services, features, content, or applications we make available (collectively, the "Services").

By accessing, browsing, registering for, or otherwise using the Services, you acknowledge that you have read these Terms, that you understand them, and that you agree to be bound by them in full. If you do not agree to any part of these Terms, you must immediately stop using the Services, sign out of your account, and, where applicable, leave the associated Discord server.

The Services are operated by volunteer staff of a virtual aviation community and are provided in connection with the 24 (Twenty‑Four) flight‑simulation environment on the Roblox platform. We are not affiliated with any real‑world civil aviation authority, air navigation service provider, air traffic control organisation, airline, aircraft manufacturer, or with Roblox Corporation. Nothing on the Services constitutes real‑world aviation training, certification, licensing, endorsement, or operational guidance.

2. Eligibility and age requirements

The Services are directed at users aged thirteen (13) or older. You may not access, register for, or use the Services if you are under 13. If you are between 13 and the age of legal majority in your jurisdiction, you may only use the Services with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

Certain application pathways require you to be at least a specified minimum age, as shown on the relevant application form. You must not falsify your age, identity, Discord ID, or any other information when applying. Providing false information is grounds for immediate rejection or removal from the community.

By using the Services you represent and warrant that: (a) you have the legal capacity to enter into these Terms; (b) all information you provide is true, accurate, current, and complete; (c) you will keep that information up to date; and (d) your use of the Services does not violate any applicable law, regulation, or third‑party right.

3. Accounts, authentication and security

To access most of the Services you must sign in with a Discord account through our authentication provider. When you sign in, we receive from Discord your user ID, username, avatar, and email address. We use this information to create and manage your account, associate you with your applications, exams, training progress, sessions, roles, and coordination activity, and to communicate with you.

You are responsible for all activity that occurs under your account, whether or not you authorised it. You must keep your Discord credentials confidential, enable multi‑factor authentication where available, and notify us immediately at the contact address in Section 22 if you suspect unauthorised access. We may suspend or terminate any account that we reasonably believe has been compromised, shared, sold, or used in violation of these Terms.

You must not create an account using another person's identity, use a shared account, operate more than one account per person without our written permission, transfer your account, or attempt to impersonate any staff member, instructor, controller, pilot, partner, or other user.

4. Description of the Services

The Services include, without limitation: the public website; account registration and profile management; role assignments; applications to join staff, instructor, and controller programmes; interviews; training requests, sessions, resources, endorsements, and checklists; exam assignments, exam questions, exam responses, and instructor review; scheduled events, event applications, and event coordination; leave‑of‑absence requests; supervision assessments; instructor recordings and notes; coordination rooms and messages; Discord bot interactions, buttons, and announcements; webhooks; and any related communications, notifications, and public listings such as team and partner pages.

We may add, remove, modify, discontinue, or restrict any part of the Services at any time, with or without notice. We may impose limits on features, storage, use, sessions, or number of applications and exams. We may perform maintenance, upgrades, and outages. We provide the Services on a best‑effort volunteer basis and do not guarantee availability, uptime, or continuity.

5. Community rules and code of conduct

All members of the Academy and the associated Discord community must behave respectfully and lawfully. Without limiting any other provision of these Terms, you agree not to:

  • Harass, threaten, stalk, defame, intimidate, or discriminate against any person on any basis, including but not limited to race, ethnicity, national origin, religion, disability, age, gender, gender identity, sexual orientation, or medical condition.
  • Post, transmit, or link to content that is unlawful, obscene, sexually explicit, sexually suggestive involving minors, hateful, violent, gory, self‑harm‑promoting, or otherwise offensive.
  • Engage in doxxing, sharing of private information of any person without consent, or non‑consensual recording.
  • Impersonate any staff member, instructor, controller, pilot, event organiser, partner, or third party, or misrepresent your affiliation with any person or entity.
  • Use the Services to distribute malware, phishing links, unsolicited commercial messages, cryptocurrency schemes, or fraudulent content.
  • Attempt to gain unauthorised access to accounts, servers, databases, edge functions, storage buckets, private channels, admin tools, or any other component of the Services.
  • Scrape, crawl, mirror, or systematically download the Services or their content without our written permission.
  • Interfere with, disrupt, or place an unreasonable load on the Services, the underlying infrastructure, our Supabase project, our Discord bot, or third‑party providers.
  • Use automation, bots, macros, or scripts to interact with the Services other than as expressly permitted.
  • Cheat, collude, or otherwise dishonestly obtain a passing exam grade, endorsement, rating, promotion, or role.
  • Violate the rules of the 24 flight‑simulation environment, the Roblox Terms of Use, the Roblox Community Standards, or the Discord Community Guidelines.

We may issue warnings, mute, remove, suspend, ban, or revoke roles for any conduct that we consider a violation of these Terms or of community norms, at our sole discretion and without prior notice. Enforcement decisions are final unless we choose to reconsider them on appeal to the leadership team.

6. Applications, interviews and role assignments

Certain positions within the Academy - including but not limited to instructor, controller, event staff, and management roles - require an application, and in some cases a follow‑up interview. When you submit an application you consent to us storing, reviewing, and acting upon the information you provide, including free‑text answers, your Discord ID, your age, your reason for applying, and any additional answers required by the application configuration.

To help us detect academic dishonesty, plagiarism, and improper assistance, our application and exam forms may automatically record client‑side activity signals such as paste events, tab‑visibility changes, and browser focus changes while you are completing the form. This activity log is stored with your submission, is only visible to authorised reviewers, and is retained for the same period as the submission itself. You should not disclose or discuss the existence of this monitoring with candidates you evaluate.

Decisions to accept, deny, promote, demote, suspend, or remove any user from a role are made by our staff at their sole discretion, based on suitability, community fit, activity, conduct, exam performance, availability, and other factors. We are not obliged to provide reasons for a decision, but we may do so as a courtesy.

Roles granted through the Services on Discord confer no property right, employment right, contractual guarantee, or ownership. Roles may be revoked at any time. Volunteer positions do not create an employment, agency, partnership, or franchise relationship between you and us.

7. Training programmes, exams and endorsements

The Academy offers training courses, checklists, scheduled and recurring sessions, exams, endorsements, and supervision assessments for virtual air traffic controllers, virtual pilots, and other participants. All training is delivered on a volunteer basis for entertainment and educational purposes within the 24 flight‑simulation environment. It is not, and must not be represented as, real‑world flight or air traffic control training.

When you take an exam through the Services, you agree to complete it honestly, without unauthorised assistance, communication, external resources, or collaboration. As stated in Section 6, exams may log paste events, tab‑visibility changes, and browser focus changes as part of anti‑cheating measures. Any exam submission may be subject to manual review, regrading, invalidation, or referral to enforcement action. You are responsible for ensuring you have a stable connection and suitable environment while attempting exams.

Endorsements, training stages, ratings, positions, and similar credentials issued through the Services are internal to the Academy and the 24 community, are non‑transferable, and may be modified, suspended, or revoked at any time.

8. Events, positions, coordination and leave of absence

The Academy runs scheduled events, event positions, position applications, invites, and coordination rooms. Availability of positions is subject to change. Attendance and participation are voluntary. We may cancel, reschedule, split, or reassign events, positions, invitations, and rooms without notice.

Members may submit leave‑of‑absence ("LOA") requests through the Services. Approved LOA does not create any right to a position, roster slot, event assignment, endorsement, or role upon return. Repeated inactivity, whether or not covered by LOA, may result in role revocation or removal from the community as described in Section 5.

9. User content and licence to us

The Services allow you to submit information, text, images, links, coordination messages, notes, answers, feedback, and other content ("User Content"). You retain all rights you already have in your User Content. You are solely responsible for your User Content and for ensuring that you have all rights necessary to submit it.

By submitting User Content, you grant us a worldwide, non‑exclusive, royalty‑free, sublicensable, transferable, perpetual, and irrevocable licence to host, store, cache, reproduce, transmit, publish, publicly display, translate, adapt, distribute, and otherwise use the User Content in connection with operating, providing, improving, promoting, moderating, backing up, and protecting the Services, and for any other lawful purpose consistent with these Terms and our Policies. This licence includes the right to remove, edit, moderate, or refuse to publish any User Content at our sole discretion.

You represent and warrant that your User Content: (a) does not infringe any intellectual property, privacy, publicity, or other right of any person; (b) is not defamatory, unlawful, or otherwise in breach of Section 5; and (c) does not contain personal information about any third party for which you do not have the necessary consents.

10. Intellectual property of the Academy

All software, source code, layouts, designs, branding, logos, wordmarks, graphics, illustrations, icons, animations, videos, audio, text, documentation, exam questions, training material, checklists, procedures, and other content made available through the Services, other than your User Content, are owned by us or our licensors and are protected by copyright, trademark, database, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non‑exclusive, non‑transferable, non‑sublicensable licence to access and use the Services for the sole purpose of participating in the community as an end user. No other rights are granted. You must not reproduce, copy, republish, sell, licence, adapt, translate, decompile, disassemble, reverse engineer, or create derivative works from any part of the Services, except to the extent that applicable law prohibits such restriction.

Third‑party names, logos, and marks referenced within the Services, including but not limited to those of Roblox Corporation, 24, Discord Inc., Supabase Inc., Lovable, Cloudflare Inc., and any airline, aircraft, airport, or authority, are the property of their respective owners and are used for identification purposes only. Their appearance does not imply endorsement.

11. Payments and virtual items

The Services are currently offered free of charge. We do not sell subscriptions, memberships, exam attempts, endorsements, ratings, roles, or in‑game currency. We do not accept donations, tips, or payments through the Services, and any purported offer to sell an Academy role or credential is prohibited and void. If we introduce paid features in the future, we will publish additional terms that govern them, and your continued use will be subject to those terms.

12. Third‑party services and integrations

The Services rely on and integrate with third‑party services, including without limitation Discord Inc. for authentication and community features, Supabase Inc. for data storage and infrastructure, Cloudflare Inc. for hosting and edge delivery, Lovable for platform operation, and Roblox Corporation for the underlying flight‑simulation environment. Your use of those third‑party services is subject to their own terms and privacy policies. We are not responsible for the acts, omissions, availability, security, or content of any third party.

Links to external sites, invite codes, partner communities, and Discord invites are provided for convenience only. We do not endorse and are not responsible for the content, practices, or terms of any linked or partnered service or community. Accessing them is at your own risk.

13. Feedback

If you provide us with feedback, suggestions, ideas, or improvements about the Services ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty‑free, fully paid‑up, transferable, and sublicensable licence to use, reproduce, modify, and exploit the Feedback for any purpose, without compensation or attribution.

14. Disclaimers

To the maximum extent permitted by law, the Services are provided "AS IS" and "AS AVAILABLE", with all faults, and without warranties of any kind, whether express, implied, statutory, or otherwise. We specifically disclaim all warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, non‑infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the Services will be uninterrupted, timely, secure, or error‑free; that the results obtained from the Services will be accurate or reliable; that any errors will be corrected; or that the Services or the servers that make them available are free of viruses or other harmful components. Any exam, endorsement, rating, role, or training outcome is for entertainment and educational purposes within a flight‑simulation community and does not confer any real‑world qualification or authorisation.

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the exclusions in this Section apply only to the maximum extent permitted by law.

15. Limitation of liability

To the maximum extent permitted by law, in no event will we, our staff, volunteers, instructors, controllers, moderators, partners, contributors, licensors, or service providers be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for lost profits, lost revenue, lost data, loss of goodwill, loss of opportunity, loss of use, or business interruption, arising out of or in connection with these Terms, the Services, your User Content, any exam result, any role decision, any moderation decision, or any third‑party service, whether based on contract, tort (including negligence), strict liability, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our aggregate liability arising out of or in connection with these Terms or the Services, from all causes of action and under all theories of liability, will not exceed one hundred United States dollars (USD 100.00) or, if greater, the total amounts you have paid to us for the Services in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow limitations or exclusions of liability for consequential or incidental damages. In such jurisdictions, the limitations in this Section apply only to the maximum extent permitted by law, and nothing in these Terms limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

16. Indemnity

You agree to defend, indemnify, and hold harmless the Academy and our staff, volunteers, contributors, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or connected with: (a) your use of and access to the Services; (b) your violation of any part of these Terms; (c) your violation of any third‑party right, including without limitation any intellectual property, privacy, or publicity right; (d) any User Content you submit; or (e) any claim that your acts or omissions caused damage to a third party. We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you will cooperate with us.

17. Suspension, termination and effect of termination

You may stop using the Services at any time. You may request account deletion as described in our Policies page. We may suspend, restrict, or terminate your account and your access to any part of the Services, with or without notice and with or without cause, including for violation of these Terms, suspected fraud, prolonged inactivity, or in response to a legal or safety concern.

Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination will survive, including without limitation Sections 9, 10, 13, 14, 15, 16, 18, 19, 20, and 21. Removal from the associated Discord server may occur separately or in addition to termination of your website account.

18. Changes to these Terms

We may modify these Terms from time to time. If we make material changes, we will notify you by updating the "Last updated" date at the top of these Terms and, where practicable, by posting a notice in the Discord community or on the website. Your continued use of the Services after any modification constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services.

19. Governing law and dispute resolution

These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or their formation (including non‑contractual disputes or claims) are governed by the laws of the jurisdiction in which the Academy's leadership team primarily resides, without regard to conflict‑of‑laws principles. To the extent permitted by law, you and we submit to the exclusive jurisdiction of the courts of that jurisdiction to resolve any such dispute or claim. Nothing in this Section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction.

You and we agree that any dispute will be resolved on an individual basis. Class actions, class‑wide arbitration, private attorney‑general actions, and any other proceeding where anyone acts or proposes to act in a representative capacity are not permitted, to the maximum extent allowed by law. If this waiver is found unenforceable, the entirety of this dispute‑resolution provision will be null and void, but the rest of these Terms will remain in effect.

20. Export controls and sanctions

You represent that you are not located in, and are not a national or resident of, any country or territory subject to comprehensive sanctions administered by the government of the country whose laws govern these Terms, and that you are not identified on any list of prohibited or restricted parties. You agree not to use the Services in violation of any applicable export‑control or sanctions law.

21. Miscellaneous

These Terms, together with our Policies page and any additional terms we publish in connection with a specific feature, constitute the entire agreement between you and us regarding the Services and supersede all prior or contemporaneous understandings. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms without restriction. Headings are for convenience only and do not affect interpretation. The words "including" and "include" mean "including without limitation".
